This website is operated by PalaFox Labs LLC d/b/a Kitty Kapital ("Kitty Kapital," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of kittykapital.com, your purchases from Kitty Kapital, and related products, content, customer support, and services (collectively, the "Services").
By visiting our website, placing an order, creating an account, submitting information, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility and Acceptable Use
By using the Services, you represent that you are legally capable of entering into a binding agreement or are using the Services with the permission of a parent or legal guardian.
You may not use the Services for any unlawful, fraudulent, abusive, or unauthorized purpose. You may not interfere with the operation, security, or integrity of the Site or attempt to gain unauthorized access to any system, account, or data.
2. Products and Product Information
We make reasonable efforts to accurately display and describe our products. Product appearance, colors, packaging, dimensions, and other characteristics may appear differently depending on your device, display settings, manufacturing variations, or updated packaging.
Product descriptions and specifications may be updated from time to time. We reserve the right to correct errors, inaccuracies, or omissions and to update information without prior notice where permitted by law.
3. Prices, Promotions, and Availability
Prices are displayed in U.S. dollars unless otherwise indicated. Prices, promotions, product availability, bundles, discounts, and shipping offers may change at any time before an order is placed.
Applicable sales tax may be calculated and charged during checkout. Placing an item in your cart does not reserve inventory. We may limit quantities or discontinue products at our discretion.
4. Orders
Submitting an order constitutes an offer to purchase the products shown in the order. We reserve the right to accept, reject, or cancel an order where reasonably necessary, including because of suspected fraud, pricing or inventory errors, payment problems, shipping restrictions, or other circumstances affecting our ability to fulfill the order.
If we cancel an order after payment has been collected, we will issue an appropriate refund to the original payment method. Customers are responsible for providing accurate billing, shipping, and contact information.
5. Payment
Payment must be successfully authorized before an order is processed. Payments are handled through Shopify and/or other payment service providers made available during checkout.
Use of a payment method may also be subject to the terms and privacy practices of the applicable financial institution or payment provider.
6. Shipping and Delivery
Kitty Kapital currently ships to all 50 U.S. states and Washington, D.C. Shipping to APO/FPO/DPO addresses and U.S. territories may be available where supported at checkout.
Our current standard offer is free U.S. shipping. Most orders are estimated to arrive within 2–5 business days. This is an estimate, not a guaranteed delivery date.
Orders may be shipped through USPS, UPS, or another suitable carrier. We do not guarantee a particular carrier or service level. Alaska, Hawaii, military addresses, U.S. territories, remote locations, severe weather, holidays, carrier disruptions, and other circumstances may require additional transit time.

7. Returns and Refunds
Eligible purchases may be returned within 30 days after the customer receives the product, subject to our Refund and Return Policy.
Opened or used WhiskerWell fountains may be eligible for return during the applicable return period. Opened or used replacement filters are not returnable. Customers are responsible for return shipping unless otherwise required by law or expressly agreed by Kitty Kapital. We do not charge a restocking fee under the current return policy.
All returns must be authorized before shipment. Refunds are issued to the original payment method in accordance with our Refund and Return Policy.
8. Limited Warranty
WhiskerWell fountains include a 1-year limited warranty. Warranty service is separate from the 30-day return period and requires return of the applicable product.
Warranty claims must be initiated by contacting us at inquiries@kittykapital.com and following the return instructions we provide. The warranty does not create a lifetime warranty or guarantee uninterrupted or fault-free operation.
Nothing in these Terms limits rights that cannot legally be excluded under applicable consumer-protection laws.
9. Product Use and Pet Safety
Products must be used according to applicable instructions, warnings, maintenance requirements, and intended use. Customers are responsible for supervising pets appropriately, maintaining products, replacing consumable components when necessary, and discontinuing use of damaged components.
WhiskerWell and other Kitty Kapital pet products are not veterinary or medical devices and are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Consult a veterinarian regarding concerns about your pet's health, hydration, diet, or medical condition.
10. Shopify and Third-Party Services
Our online store is hosted by Shopify. Shopify processes personal information when you visit or make purchases from our store, including to provide services based on your interactions with Kitty Kapital, other Shopify merchants, and Shopify.
Information may be shared with Shopify and other service providers, including providers located in other countries, as necessary to provide ecommerce, payment, analytics, personalization, fraud-prevention, advertising, and other services.

11. Intellectual Property
The Site and its contents, including Kitty Kapital and WhiskerWell branding, logos, graphics, photographs, videos, text, advertising materials, product presentation, website design, and other content, are owned by or licensed to PalaFox Labs LLC unless otherwise stated.
You may use the Site for personal, noncommercial purposes. You may not reproduce, distribute, modify, publish, sell, exploit, or create derivative works from protected Site content without permission, except as permitted by applicable law.
12. User Submissions
If you submit reviews, photographs, comments, testimonials, feedback, ideas, or other content, you represent that you have the right to provide that content and that the submission does not violate applicable law or the rights of another person.
Where permitted by law and any terms presented at submission, you grant us the rights reasonably necessary to display, reproduce, and use submitted content in connection with operating and promoting Kitty Kapital.
13. Privacy
Our collection and processing of personal information is described in our Privacy Policy. Please review it before using the Services.
14. Disclaimer of Warranties
Except for warranties expressly provided by Kitty Kapital and to the fullest extent permitted by law, the Site and Services are provided on an "as available" basis. We do not warrant that the website will always be uninterrupted, error-free, or secure.
Nothing in this section excludes warranties or consumer rights that cannot legally be waived.
15. Limitation of Liability
To the fullest extent permitted by applicable law, PalaFox Labs LLC and its members, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Services.
Where liability cannot legally be excluded, our liability will be limited only to the extent permitted by applicable law. Nothing in these Terms limits liability that cannot legally be limited or excluded.
16. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless PalaFox Labs LLC and its affiliates from claims, liabilities, damages, or expenses resulting from your unlawful misuse of the Services or violation of these Terms.
17. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.
18. Severability
If any provision of these Terms is determined to be unlawful or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
19. Changes to These Terms
We may update these Terms periodically. The current version will be posted on the Site with the applicable Last Updated date.
